This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 149/2025 registered at Police Station – Basna, District Mahasamund (C.G.), for the offence punishable under Section 20(b) of the Narcotics Drugs and Psychotropic Substances Act. 2. As per the prosecution story, in brief, the concerned Police Station Basna received secret information through an informant that, on the date of the incident, an unknown person had kept illegal contraband ganja in his Swift car for sale. Acting upon the said information, the police seized ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.03.24 12:49:28 +0530 2 20.400 kg of ganja from the place of the incident, which was an open area. Accordingly, the police registered an offence punishable under Section 20(b) of the NDPS Act against the applicant. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article i.e. 20.400 Kgs of was not seized from the possession of the present applicant. He also submits that the present applicant has no criminal antecedents and he is in jail since 12.04.2025, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that, in the present matter, the charge-sheet has already been filed before the competent Court. He further submits that 20.400 kilograms of ganja, which is above the commercial quantity, was recovered from the vehicle of the present applicant, which he was driving at the time of the incident. He also submits that the bail application of a co-accused person, namely, Leeladhar Choudhary @ Krishna Choudhary, has already been rejected by this Court vide order dated 10.07.2025 passed in MCRC No. 5354 of 2025, and therefore, the present bail application also deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the submissions made by learned State counsel and upon perusal of the case diary, this Court finds that 20.400 kilograms of ganja, which is above the commercial quantity, has been recovered from the vehicle of the present applicant, which he was driving at the time of the incident. Further, the bail application of the co-accused person, namely, 3 Leeladhar Choudhary @ Krishna Choudhary, has already been rejected by this Court vide order dated 10.07.2025 passed in MCRC No. 5354 of 2025, therefore, the bail application of the present applicant is also entitled to be rejected. 7. Accordingly, the bail application of the applicant – Mohd. Yasin, filed under Section 483 of the BNSS, involved in Crime No. 149/2025 registered at Police Station – Basna, District Mahasamund (C.G.), for the offence punishable under Section 20(b) of the Narcotics Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
