The petitioners are apprehending his arrest in connection with Radhanagar PS Case No.147 of 2026, for offence registered under section 69, 351(2) and 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, First Class, Rajmahal. 3. Learned counsel for petitioners submits that the petitioners are father, mother and younger brother of the main accused namely, Debashish @ Raja Mandal. He next submits that the allegations are there against said Debashish @ Raja Mandal of establishing relationship with the victim on the pretext of marriage. He next submits that so far as these petitioners are concerned, they having nothing to do with the said allegation, however, they have been made accused. He also submits that the said Debashish @ Raja Mandal has been granted regular bail by the Co-ordinate Bench of this Court. 2026:JHHC:19297 2 4. Learned State counsel opposes prayer and submits that the petitioners happened to be father, mother and younger brother of the main accused namely, Debashish @ Raja Mandal and the allegations are made that when the brother of the victim has gone to their house, they have stated that they will not solemnize the marriage. 5. On perusal of the FIR, it transpires that there is allegation against Debashish @ Raja Mandal of establishing relationship and these petitioners are father, mother and younger brother of said Debashish @ Raja Mandal and only allegation is made against the petitioners that they have refused to solemnize the marriage and further said Debashish @ Raja Mandal has been granted regular bail by Co-ordinate Bench of this Court, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to the satisfaction of learned Judicial Magistrate, First Class, Rajmahal, in connection with Radhanagar PS Case No.147 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
