No.1087 of 2026
The present application has been filed by the State for condonation of delay of 174 days in filing the review petition, against the judgment dated 04.11.2025, passed in LPA No.127 of 2022, titled, State of Himachal Pradesh and others vs. Sandeep Kumar, which is supported by an affidavit of a high ranking Police Officer. The same is allowed. Review Petition No.82 of 2026
2. A perusal of the judgment as such would go on to show that a detailed reference to various case laws has been made and two cases against the employee were registered when 1Whether reporters of the local papers may be allowed to see the judgment?
2 he was only 19-20 years of age and had only been convicted and fined for Rs.100/- for commission of an offence under Section 160 of IPC and sentenced till the rising of the Court in one case i.e. FIR No. 3/2026. Even thereafter also, he was acquitted by the Additional Sessions Judge, Fast Track Court, Shimla. In such circumstances, keeping in view of the young age of the person at the time when the incident had taken place, we had upheld the orders of the learned Single Judge, wherein direction had been issued to offer him appointment.
3. We are of the considered opinion that we had not interfered with the order dismissing the appeal of the State, which is based on a settled principle of law and binds us on the basis of precedential value of the judgments of the Apex Court. Resultantly, we find no error apparent on the face of the record.
4. Resultantly, the Review petition would meet its fate of dismissal. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
