Order No.02 Dated-02-07-2026
Heard the parties.
The petitioner has been made accused in connection with Senha P.S. Case No.65 of 2024 (S.T. Case No.112 of 2024) registered under Section 103 (1)/3 (5), 238 (a)/3 (5) of the B.N.S., 2023.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused, has committed the murder of her own husband namely Ajit Oraon because she was in love with one Arjun Tana Bhagat-who is a juvenile in conflict with law. It is submitted that the allegation against the petitioner is false. It is further submitted that the said Arjun Tana Bhagat, who is a juvenile, has since been admitted to bail. It is also submitted that the petitioner has been implicated in this case only on the basis of her own extrajudicial confession made before the Mukhiya and other villagers leading to discovery of the dead body of her husband which she and the co- accused kept hiding to screen themselves of the offence. It is next submitted that the petitioner has falsely been implicated in this case because of property dispute in the family. It is lastly submitted that the petitioner has been in custody since 03.08.2024. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the overwhelming evidence that has come through the witnesses already examined in the trial of the case and the direct allegation of serious nature against the petitioner of committing the murder of her own husband, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail at this stage.
Considering the serious nature of allegation against the petitioner as well as her chance of absconding and tampering with the evidence, this Court is of the considered view that this is not a fit case where the above- named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
