THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 1841/2026
ORDER:
The Criminal Petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2024 (for short ‘BNSS’) has been filed by the Petitioner/Accused No.2, seeking regular bail in Cr.No.861 of 2025 of Arundalpet Police Station, Guntur District, registered for the offences punishable under Section 409 read with 34 of IPC.
2. Case of the prosecution, in brief, is that the petitioner/A.2 being a Director of the company, along with the other Directors, cheated the defacto complainant to a tune of Rs.10,89,68,595/-.
3. Heard Sri S.Dilip Jaya Ram, learned counsel for the petitioner/accused No.2 and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
4.
Learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this crime and that he is in no way connected with the commission of the offence. The Petitioner has been in judicial custody since 31.12.2025. It is further submitted that this is second bail application filed by the petitioner. The earlier bail application filed by the petitioner was dismissed by this Court vide order dated 18.02.2026 in Crl.P.No.1033 of 2026. The crucial part of the investigation might have been completed by this time.
3
Learned counsel further submits that the petitioner undertakes to strictly adhere to any conditions that may be imposed by this Court.
5. Learned Assistant Public Prosecutor on behalf of the State vehemently opposed the petition and contended that there is no change of circumstances from the date of dismissal of the earlier bail application filed by the petitioner before this Court. There are independent witnesses, CDRs and bank statements showing the involvement of the petitioner. She finally prays for dismissal.
6. Considering the submissions and upon keen perusal of the material placed on record and in the light of the facts and circumstances of the case, since there are no change of circumstances from the date of dismissal of the earlier bail application, this Court is not inclined to consider the request of the petitioner for grant of bail at this stage.
7. Accordingly, the Criminal Petition is dismissed, without causing any prejudice to the rights and contentions of the petitioner. However, the petitioner is at liberty to file a fresh application at appropriate time.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
