By way of this writ petition, the petitioner has prayed for following reliefs:- “10.1) This Hon'ble Court may kindly be pleased to issue appropriate writ and quash the impugned order dated 15/3/19 (Annexure P-8) and other merged orders in the 3 interest of justice. 10.2) This Hon'ble Court may kindly be pleased to issue appropriate writ and declare new land allotted by the respondents authorities in favor of respondent no. 7 as void, illegal and contrary to the provision of the Panchayats (Extension to the Scheduled Areas) Act, 1996, Guidelines, 2016 and other relevant laws. 10.3) Alternatively, This Hon'ble Court may kindly be pleased to issue appropriate writ and direct the respondent authorities to change the present allotment of land for establishment of Bio Medical Plant and direct the respondent authorities to allot another land to respondent no. 7 far away from the petitioner gram Panchayat periphery strictly in accordance and compliance of applicable relevant laws and guidelines issued by the Supreme court in para 113 of the Samatha v. State of Andhra Pradesh, AIR 1997 SC 3297. 10.4) This Hon'ble Court may kindly be pleased to call for the entire records leading to the instant case, for kind perusal of this Hon'ble Court. 10.5) Any other relief which this Hon'ble Court deem fit and proper may also kindly be granted to the petitioner in the interest of justice along with cost of the petition..” 2. Learned counsel for the petitioner submits that he has no instructions to proceed in the present matter, as the petition was 4 originally instituted by the erstwhile Gram Panchayat and its office bearers, however, upon completion of their tenure, the newly constituted Gram Panchayat and its office bearers have not approached or engaged him in connection with the present proceedings. In the absence of any authorization or instructions from the current body, learned counsel is unable to effectively represent the petitioner. Accordingly, he seeks permission of this Hon’ble Court to withdraw the present petition, with liberty to submit that, in the event the newly constituted Gram Panchayat expresses its intention to pursue the matter, an appropriate application may be filed for continuation or revival of the proceedings in accordance with law. 3. No objection has been raised from other side. 4. Accordingly, the prayer is allowed and the instant petition is dismissed as withdrawn, with the aforesaid liberty.
