KAMAL - 3 - HC-KAR NC: 2026:KHC:25403 WP No. 14565 of 2026 ORAL ORDER Petitioner is before this Court seeking following reliefs: ''(a) ISSUE a Writ in the nature of Certiorari to quash the Seniority List dated 22-05-2025 bearing No.KruUuMaSa/Ben/ Malige Vibhaga/634/2024-25 prepared by the respondent No.3 vide Annexure-C and the Order dated 02-07-2025 bearing No.KruMaEe/AaBhivi-1/Lee & Lei/458/2024 passed by the 2nd Respondent vide Annexure-E, so far they relate to the 4th Respondent. (b) ISSUE a Writ in the nature of Mandamus, directing the Respondents No.2 and 3 to allot the Shop No.261 in the "E-Block" Dasanapura Sub-Market Yard, Bengaluru, on leave-and-licence basis; (c) ISSUE such other writ or order or direction as this Hon'ble Court deems just and proper in the facts and circumstances of the case, in the interest of justice and equity.'' 2. Learned counsel for the petitioner after arguing the matter for sometime, upon bringing to his notice regarding Rule 23 of the Karnataka Agricultural Marketing (Regulation of Allotment of Property in Market yards) Rules, 2004 (hereinafter referred to as 'the Rules, 2004') providing for revision on any decision, order or proceedings of the marketing committee, by the Director/Commissioner of Agriculture and Marketing, submits that a representation in this regard has already been made as per Annexure-D and no order has been passed thereon till date. He further submits that if a direction in this regard be issued, purpose of this petition will be served. 3. Sri. Gopal U. Bilalmane, learned counsel appearing for respondent Nos.2 and 3 submits that the representation made - 4 - HC-KAR NC: 2026:KHC:25403 WP No. 14565 of 2026 by petitioner as per Annexure-D would be considered as a revision petition contemplated under Rule 23 of the Rules, 2004 and appropriate order in this regard would be passed within an outer limit of three months. 4. Submissions placed on record. 5. Accordingly, following: ORDER (i) Petition is disposed of. (ii) The respondent No.2-Director to pass appropriate orders with respect to Annexure-D, considering the same as a revision petition as contemplated under Rule 23 of the Rules, 2004. Petitioner is also at liberty to raise further grounds, if need be. (iii) The respondent No.2-Director shall provide sufficient opportunity to the petitioner as well as respondent No.4 and pass orders in accordance with law within three months from the date of receipt of certified copy of this order.
