The present petition has been filed seeking quashing of FIR No.256/2024 dated 9th May, 2024, under Sections 498-A/406/34 of the Indian Penal Code, 1860 (‘IPC’) registered at Police Station Tilak Nagar, Delhi and all proceedings arising therefrom, on the ground of settlement arrived at between the parties. 2. The petitioner no.1 is the husband of the respondent no.2 and the petitioner no.2 is a family member of the petitioner no.1. The marriage of the petitioner no.1 and the respondent no.2 was solemnized on 12th November, 2017 as per Hindu rites and ceremonies. 3. CRL.M.C. 6654/2026 no.2, which resulted in filing of the present FIR by the respondent no.2 against the petitioners. 4. Now, the parties have settled their disputes in terms of the Settlement Agreement dated 25th August, 2025, executed before the Delhi Mediation Centre, Tis Hazari Courts which has been filed as Annexure A-3 to the petition. 5. In terms of the aforesaid settlement, the petitioner no.1 and the respondent no.2 have agreed to dissolve their marriage and obtain a decree of divorce. Further, a total sum of Rs. 6 lakhs is to be paid by the petitioner no.1 to the respondent no.2, in three equal installments. 6. Out of the aforesaid amount, a sum of Rs.4 lakhs has already been paid to the respondent no.2 and the remaining amount of Rs. 2 lakhs is being paid today by way of demand draft no. 516517 dated 10th August, 2026. A decree of divorce under Section 13A of the Hindu Marriage Act, 1955 has also been granted to the parties. 7. Issue notice. 8.
Notice is accepted by the learned APP appearing on behalf of the State and the counsel appearing on behalf of the respondent no.2. 9. The respondent no.2 is present in Court and has been identified by her counsel as well as by the Investigating Officer (IO). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the FIR. 10. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties. 11. CRL.M.C. 6654/2026 purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto. 12. To be noted, there is one minor child born from the wedlock of the parties. As per the aforesaid settlement, the custody of the minor child shall be with the mother, i.e., respondent no.2. 13. The settlement executed between the parties as well as this order shall have no effect on the rights of the minor child. 14. Consequently, the FIR No.256/2024 registered at Police Station Tagore Garden, Delhi and the proceedings pursuant thereto are quashed. 15. The petition stands disposed of.
