2/09.02.2026 Heard learned counsel appearing on behalf of Petitioner and
learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Sahibganj (M) P.S case No. 26 of 2023, registered u/s 379 & 411 of the I.P.C and section 21(A), 21(6) MMDR Act 1957 and Section 04/54 Jharkhand Mines Minerals Concession (JMMC) Rule 2004, pending in the Learned Court of A.C.J.M. at Sahibganj.

Learned counsel appearing for the petitioner submits that the allegations are made in the FIR on 22 tractors, 100 cft. stone chips on each of the tractors were loaded. She next submits that the owner and driver of one of the tractor has been granted anticipatory bail in ABA No. 3175 of 2024 and the driver of another tractor has been granted anticipatory bail in ABA No. 3359 of 2024. She next submits that the petitioner has got no criminal antecedent as disclosed in para 16 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that illegally 100 cft stone chips was loaded on each of the tractors.

Considering that the co-accused have been granted anticipatory bail in aforesaid ABAs and the petitioner is having no criminal antecedent as disclosed in Para-16 of the petition and the petitioner happened to be the driver of one of the tractor, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned A.C.J.M. at Sahibganj, in connection with Sahibganj (M) P.S case No. 26 of 2023, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and
disposed of.
