JUSTICE E.S.INDIRESH ORAL ORDER In this petition, the petitioner is challenging the Order dated 10th September, 2024 (Annexure-L) passed by the respondent No.3 in M.R. No.T15/2024-25; inter alia sought for a direction to the respondent No.3 to restore the name of the petitioner in the revenue records in respect of the land in question. - 3 - HC-KAR NC: 2026:KHC:26302 WP NO.15062 OF 2026 2. Heard Sri. H.S. Santhosh, learned counsel appearing for the petitioner; Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to 3 and Sri. Pruthvi Wodeyar, learned counsel appearing for the respondent No.5. 3. Sri. H.S. Santhosh, learned counsel appearing for the petitioner argued that, though the petitioner preferred the appeal under Section 136(2) of the Karnataka Land Revenue Act against the impugned order passed by the respondent No.3, the respondent No.2 has not considered the same. Hence, he sought for interference of this Court. 4. Per contra, Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to 3 submits that the petitioner cannot maintain parallel proceedings before the competent authority and by challenging the same before this Court in the present petition. 5. Having heard the learned counsel appearing for the parties, it is not in dispute that the impugned order dated 10th September, 2024 (Annexure-L) passed by the respondent No.3 is an appealable order before the respondent No.2 herein and - 4 - HC-KAR NC: 2026:KHC:26302 WP NO.15062 OF 2026 accordingly, the petitioner has preferred the appeal. In that view of the matter, the petition/r is hereby directed to appear before the respondent No.2 on 15th June, 2026 at 2.30 pm. The respondent No.2 shall consider the appeal preferred by the petitioner on merits after affording opportunity of hearing to all parties concerned and take decision in the matter in accordance with law at the earliest.
