By way of the present application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), the Applicant seeks grant of anticipatory bail in FIR No. 60000382/2026, registered at Police Station Cyber Rohini (North), Delhi, under Sections 308, 318(4) and 319 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’). Learned counsel for the Applicant submits that the Applicant is only 19 years of age and had provided his account number to the other co-accused persons. Except for the aforesaid, he does not know of any cyber fraud being committed. He further submits that only an amount of Rs. 40,000/- was credited to the Applicant’s account, which was subsequently withdrawn and handed over to the other co-accused person. 5. Per contra, learned APP for the State submits that the present case pertains to an online cyber fraud involving an investment scheme, wherein cheating of an amount of Rs. 12,97,000/- was committed. Though an amount of only Rs. 40,000/- was credited to the Applicant’s account, it is submitted that despite the protection granted by the learned Sessions Court, the Applicant did not properly join the investigation. It is further submitted that custodial interrogation of the Applicant is necessary to ascertain the details of the money trail and the identity of the other co-accused persons. 6. This Court has heard learned counsel for the Applicant and the learned APP for the State. 7. It is an admitted fact that only an amount of Rs. 40,000/- was credited to the Applicant’s account. The main amount of Rs. 10,57,000/- was credited to the account of another co-accused, who is yet to be arrested by the police. The only role attributed to the Applicant is that he received an amount of Rs. 40,000/- and allowed the other co-accused to use his account. 8. Accordingly, in the event of arrest, the Applicant shall be released on bail on furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount, to the satisfaction of the concerned SHO/Investigating Officer, subject to the following conditions: This is a digitally signed order. i) The Applicant shall join the investigation as and when required by the concerned I.O/SHO. and shall cooperate with the investigation in all respects. ii) The Applicant shall remain available on mobile numbers shared by him with the Police. ii) The Applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner.
iii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO. 9. The present application is disposed of in the above terms. Pending application(s), if any, also stand disposed of. 10. Needless to state, nothing stated herein shall be construed as an expression on the merits of the case. 11.
