1. The petitioner seeks to challenge the order dated 07.09.2026, whereby his parole application has been rejected solely on the ground that the convict had last availed furlough for a period of two weeks w.e.f. 30.04.2026 to 14.05.2026 and that no specific ground exists for grant of parole.
2. The Court finds that, the petitioner seeks parole on the ground of maintaining family and social ties. Maintaining family and social ties is a recognised ground for grant of parole, as has been laid down by the Supreme Court in the case of Asfaq v. State of Rajasthan and Others1. The fact that the petitioner had earlier availed furlough would, in fact, further justify the petitioner’s good conduct. There is no restriction or impediment in considering parole after expiry of one month from the date of surrender from 1 (2017 15 SCC 55 This is a digitally signed order. 3. In the instant case, the petitioner had surrendered on 14.05.2026 after completion of his period of furlough.
4. Bearing in mind the aforesaid facts and circumstances of the case, the petitioner’s application for grant of parole for a period of thirty days is allowed.
5. Let the petitioner be released on parole for a period of thirty days from the date of his release, subject to the same conditions as were imposed by the concerned authority while granting furlough.
6. Let a copy of this order be sent to the concerned Jail Authority.
7. Accordingly, the petition stands disposed of.
