1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to call the entire records from the respondents. 10.2 That, this Hon'ble Court may kindly issue a writ in the nature of Mandamus directing the respondent authority to issue Caste Certificate to the Petitioner. 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondents by issuing the writ in the nature of mandamus to provide a permanent caste certificate of Schedule Caste to the petitioner on prescribed period granted under C.G. Lok Sewa Gurantee Act, 2011. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief or pass such other and further orders as may be deemed fit and proper in the facts and circumstances of the present case in the interest of justice.”
2. Brief facts of the case, is that, the petitioner belongs to the
“Mahar” caste, which is recognized as a Scheduled Caste, and both the petitioner and his children seek to avail the benefits available to the said caste within the State of Chhattisgarh, accordingly, the petitioner submitted online applications bearing Nos. 0704012008000973 and 0704012008000974 before the competent authority for issuance of caste certificates, namely the S.D.O. (Revenue), District Durg, on 05/09/2020. It is further
3 submitted that the petitioner also furnished an Inability Memo in support of his claim. However, the petitioner has been constrained to file the present petition aggrieved by the action of the respondent competent authority, which, vide transaction description dated 06/09/2020, allegedly sought unnecessary and irrelevant documents for the issuance of a permanent social status (caste) certificate. Hence, this petition. 3. Learned counsel for the petitioner submits that the present petition has been filed seeking issuance of a writ of mandamus directing the competent authority to grant a caste certificate in favour of the petitioner for the “Mahar” community, which is recognized as a Scheduled Caste. It is further submitted that the petitioner has placed on record relevant documents, including caste certificates pertaining to his forefathers, to substantiate his claim of belonging to the said community.
Learned counsel further submits that the petitioner is presently residing within the State of Chhattisgarh and, therefore, is entitled to seek issuance of the caste certificate from the competent authorities of the said State in accordance with law. 4. On the other hand, learned counsel appearing for the State opposes the submissions advanced on behalf of the petitioner and contests the relief sought in the present petition, contending that the claim made by the petitioner is not tenable either on facts or in law and, therefore, does not warrant any interference or direction by this Hon’ble Court. 4
5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, and further taking into account that the petitioner has approached this Court with a prayer seeking a direction to the concerned respondent authorities for issuance of a caste certificate in accordance with law, it is deemed appropriate to direct the said authorities to duly consider the case of the petitioner and to pass a reasoned and appropriate order strictly in accordance with the applicable legal provisions. 7. It is made clear that this Court has not expressed any opinion on the merits of the case, and the concerned respondent authorities shall remain at liberty to independently consider the matter and pass appropriate orders strictly in accordance with law. 8. The petitioner is directed to submit an appropriate application, along with a copy of his earlier application as well as a copy of this
order, before the concerned respondent authorities within a period of 30 days from the date of receipt of this order, and, in turn, the concerned respondent authorities are directed to consider and decide the same and pass a reasoned and appropriate order in accordance with law within a further period of 60 days thereafter.
9. With this observation and direction, the writ petition is disposed of.
