This is an application U/S.483 of BNSS Act by the petitioner for grant of bail in connection with Kalinga Nagar (Duburi) PS No.233 of 2025 corresponding to Spl. GR(NDPS) Case No.50 of 2025 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Jajpur Road for commission of offences punishable U/S. 20(b)(ii)(C)/29(1) of the NDPS Act, on the main allegation of transporting 71.665Kgs of Contraband Ganja in a white colour TATA PUNCH car bearing Regd. No.OD- 33AP-9395. 3. Heard, Mr. Manas Kumar Chand, learned counsel for the petitioner and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record. On being queried about the criminal antecedent of the petitioner, Mr. Chand volunteers to withhold bail to the petitioner, if he is found to have any criminal antecedent of similar nature for commission of offence under NDPS Act. Admittedly, this is the second journey of the petitioner, but his earlier bail application was rejected during continuation of investigation, however, in the meantime co-accused-cum-owner of the vehicle namely Jaga @ Satyabrata Mohanty has already been granted bail by a co-ordinate Bench of this Court in BLAPL No.2642 of 2026. It is however, submitted that the petitioner is implicated in this case on the basis of statement of Jaga @ Satyabrata Mohanty. In the aforesaid facts and circumstances and no one being apprehended from the spot and there being claim made by the learned counsel for the petitioner for petitioner not having any criminal antecedent of similar nature, the petitioner would be considered to have satisfied the conditions of Sec.37 of NDPS Act, if he has no criminal antecedent under NDPS Act. 5. For the reason stated hereinabove and taking into the pre-trial detention of the petitioner in custody since 02.09.2025 with submission of charge-sheet in the meantime, this Court without expressing any view on merit admits the Petitioner to bail, but subject to verification of his criminal antecedents. 6. Hence, the bail application of the petitioner stand allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. Page 3 of 3 In view of the specific submission as advanced for the petitioner, the benefit of this order shall not be extended to the petitioner, if he is found to have any criminal antecedent of similar nature for commission of offence under NDPS Act. 7. Accordingly, the BLAPL stands disposed of. 8. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
