NHAI  Vs  Dinesh Kumar OMP No. 806 of 2026 in Arb. Appeal No. 129 of 2024 12.08.2026 Present: Ms. Sneh Bhimta, Advocate, vice Ms. Shreya   Chauhan,   Advocate,   for   the   non applicant. Mr. Suneet Verma, Advocate, vice Mr. Varun Rana, Advocate, for the applicant. Reply is stated to have been filed. The   present   OMP   has   been   filed   in   a decided matter.  The Arb. Appeal No. 129 of 2024, preferred   by   NHAI,   has   been   dismissed,   by   this Court, vide order dated 18.10.2024. Now,   by   way   of   the   present   application, applicant prays for release of the amount deposited by NHAI, along with upto date interest. When   put   to   notice,   the   application   has been contested, however, considering the fact that the appeal has already been dismissed and reply is totally silent about the fact whether any appeal has been preferred by NHAI before the Hon’ble Supreme Court,   then   the   said   contents   are   liable   to   be ignored. Moreover, after the dismissal of the appeal, NHAI has no locus to oppose the prayer as made in the application.   Consequently, the application is allowed   and   the   amount   of   compensation,   along with upto date interest, is ordered to be released in favour of the applicant Dinesh Kumar.  Amount to be released, shall be remitted to the bank account of   the   applicant,   particulars   of   which   have   been annexed with the application. Application is accordingly disposed of. ( Virender Singh ) Judge 12th August, 2026 (Pramod Kumar)
