JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused No.1 in S.C.No.186/2025 pending before the Court of VI Addl. District and Sessions Judge, Bengaluru Rural, Bengaluru District arising out of Crime No.125/2025 registered by Kaggalipura Police Station, Ramanagara District for the offence punishable under Section 103(1) R/w 3(5) of BNS, 2023 is before this Court seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.125/2025 was registered by Kaggalipura Police Station, Ramanagara District for the aforesaid offence against the petitioner and two others, on the basis of first information dated 10.04.2025 received from Sri Darsha son of the deceased Nagaraju. During the course of investigation, the petitioner who was arraigned as accused no.1 in the FIR was arrested on 10.04.2025 - 3 - HC-KAR NC: 2026:KHC:25796 CRL.P No. 2660 of 2026 and remanded to judicial custody. Investigation of the case is completed and charge sheet has been filed against three persons. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.43/2026 was dismissed on 02.02.2026. Therefore, he is before this Court. 5. Perusal of the material on record would go to show that, allegation of assaulting the deceased Nagarju with wickets is found as against accused nos.1 to 3. Undisputedly, the petitioner herein who has no other criminal antecedents is in custody from 10.04.2025. Accused nos.2 and 3 as against whom similar allegations are found in the charge sheet have been granted regular bail by this Court in Crl.P.No.15328/2025 and Crl.P.No.13315/2025. In Crl.P.No.13315/2025 while granting regular bail to accused no.3, in paragraph no.6, the Coordinate Bench of this Court has observed as follows:- - 4 - HC-KAR NC: 2026:KHC:25796 CRL.P No. 2660 of 2026 "The accusation against accused Nos.1 to 3 as per charge sheet is that, on 09.04.2025 at about 08.00 p.m. when the accused persons were consuming alcohol in front of the house of deceased, at that time, the deceased told them not to drink alcohol in that place. At that time, accused Nos.1 to 3 have assaulted the deceased with wickets on his head, shoulder, back and due to which, he died on 10.04.2025 in the hospital. There are no eye witnesses to the incident and the case of the prosecution is based on circumstantial evidence. Except a joint recovery of three (3) pieces of cricket wickets from accused Nos.1 to 3, there are no other recoveries or circumstances against the petitioners. The said wickets recovered at the instance of accused persons are found to be blood stained as per FSL report. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The petitioner is in judicial custody since 11.04.2025 and therefore, he is not required for custodial interrogation. There are no criminal antecedents of the petitioner". 6. Subsequently, accused no.2 was granted bail in Crl.P.No.15328/2025. Undisputedly, the petitioner who had similarly placed with accused nos.2 and 3 in the - 5 - HC-KAR NC: 2026:KHC:25796 CRL.P No. 2660 of 2026 present case is also entitled for grant of regular bail on the ground of parity. 7. Accordingly, the following:- ORDER The petitioner is directed to be enlarged on bail in S.C.No.186/2025 pending before the Court of VI Addl. District and Sessions Judge, Bengaluru Rural, Bengaluru District arising out of Crime No.125/2025 registered by Kaggalipura Police Station, Ramanagara District for the offence punishable under Section 103(1) R/w 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR NC: 2026:KHC:25796 CRL.P No. 2660 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS/List No.: 1 Sl No.: 68
