The present petition has been filed under Section 482 BNSS, 2023 seeking grant of anticipatory bail to the petitioner in case bearing FIR No.292 dated 11.11.2025 under Sections 118(1), 351(2), 3(5) of BNS registered at Police Station Lambi, District Sri Muktsar Sahib.

Briefly stated that on 06.11.2025 the complainant was standing outside his shop when Gurdas Singh (the present petitioner), Parkash Singh, Manak Singh and Sunil Singh came there and Parkash Singh raised lalkara while saying that they will teach the complainant a lesson for beating his father. Then Manak Singh grabbed right arm of the complainant & twisted it and Sunil Singh pulled complainant’s hair and punched at his back. Then Gurdas Singh (the present petitioner) hit the complainant with the kirch which hit his left arm on the back of the bicep and thereby resulted in bleeding from the said arm. of the complainant, all the accused ran away from the spot with their weapons while threatening the complainant.

Learned counsel for the petitioner contended that the present FIR is a counter-blast to the FIR which was earlier registered by the father of the petitioner, with the motive to pressurize the petitioner to compromise the matter in the other FIR. The injury attributed to the petitioner is simple in nature; co-accused namely Arshdeep Singh @ Manak Singh has been granted anticipatory bail vide order dated 02.04.2026 passed by learned Additional Sessions Judge-I, Sri Muktsar Sahib and Parkash Singh has been granted the concession of interim bail vide order 18.03.2026 by learned Additional Sessions Judge-I, Sri Muktsar Sahib; the petitioner has clean & clear antecedents and is not involved in any criminal activity. Hence, learned counsel for the petitioner sought relief of anticipatory bail to the petitioner as he is ready and willing to join the investigation. 4. Notice of motion. 5. Mr. Anup Singh, AAG, Punjab, who is present in Court, accepted notice on behalf of respondent-State and opposed the grant of anticipatory bail to the petitioner while submitting that the main allegation is against the present petitioner, who was armed with a kirch at the time of the alleged occurrence and is attributed a kirch blow on the left arm of the complainant. However, he does not dispute the fact that the injury caused to the complainant is simple in nature and the alleged offences qua the present petitioner are triable by the Magistrate wherein SONIA PURI 2026.04.21 09:37 I attest to the accuracy and integrity of this document

maximum sentence provided for the said offences is upto 07 years. He also fairly admitted that the petitioner is having clean & clear antecedents. 6. Heard. 7.
Keeping in view the contentions made by learned counsel for the parties and the fact that the injuries caused in the present case simple in nature; offences in the present FIR are triable by the Magistrate and the maximum punishment for the alleged offences provided under the relevant provisions of law is 07 years; the petitioner is having clean & clear antecedents and is not involved in any other case except the present case; the present petition is disposed of with a direction to the petitioner to join the investigation, as and when required by the Investigating Officer and as the offences in the present case are punishable upto 07 years, the Investigating Officer is directed to follow the directions of the Hon’ble Supreme Court in Arnesh Kumar vs. State of Bihar and Another (2014), 8 SCC 273 and Satender Kumar Antil v.
