The affidavit of service filed in Court today is taken on record. The petitioners claim to be owners of the plot nos. 133 and 65, within Mouza Murutia under Police Station Karimpur (at present Murutia), in the District of Nadia. The petitioners allege that there is a PWD road running in front of the aforesaid plots of the petitioners and a portion of the same has been encroached upon by the private respondent by erecting structures thereupon. The petitioners submitted a representation before the concerned respondent authorities dated October 29, 2025 praying for removal of the said unauthorized pucca construction on the PWD road. Learned Advocate appearing for the petitioners submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioners till date.
Learned Counsel appearing for the State submits that if, upon enquiry, any encroachment is found, steps in accordance with law shall be taken. In the light of the submissions made by the learned Advocates for the respective parties, WPA 28583 of 2025
stands disposed of by directing the Assistant Engineer, Directorate of Public Works Department, Plassey Highway Sub-Division, being the respondent no.2, to consider the representation of the petitioners dated October 29, 2025 and after making necessary enquiry, if any encroachment upon the PWD road is found, steps in accordance with Section 10 of the West Bengal Highways Act, 1964 shall be taken. The entire exercise under the said provision shall be completed as early as possible but positively within a period of six weeks from the date of receipt of a server copy of this
order along with a copy of the representation dated October 29, 2025. Urgent photostat certified copy of this order, if applied for be supplied to the parties upon compliance of all requisite formalities.
