1. The present appeal has been filed under Order XLIII Rule 1 read with Section 151 of the Code of Civil Procedure, 1908, seeking setting aside of the impugned order dated 10.03.2026 passed by the learned District Judge- 10 (Central) Tis Hazari Courts, Delhi in CS DJ 619994 of 2016, titled as This is a digitally signed order. After initial submissions, learned Senior Counsels appearing for the parties have informed the Court that the eviction proceedings have been initiated by respondent nos. 1 and 2 against the present appellant, wherein the appellant has disputed the title to the suit property. 3. The observations of the Trial Court in paragraphs 34 and 35 of the impugned order, including the observation that the “balance of convenience lies in favour of the defendants no. 1 and 2 as to as restrain the plaintiffs from recovering possession of the portions of the suit property from various tenants/occupiers under eviction petitions under the DRC Act as per law.”, shall not prejudice the contentions of the present appellant in the said proceedings. The contentions raised therein shall be considered by the concerned Court on its own merit and in accordance with law. 4.
