1. Heard learned counsel for the petitioners and learned A.P.P. for the State, Ms. Gulnar Begum.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that she was cutting sugarcane on her land when accused persons including the petitioners came and started claiming the land, further Jawahir assaulted the informant by farsa causing injury on head, while Rajesh assaulted her by lathi all over the

No.37583 of 2026(2) dt.18-06-2026 2/3 body and snatched her mangalsutra, thereafter Ramashankar assaulted Anita by gadasa causing injury on head, further Marcho Devi snatched nose pin of the informant and Rajesh along with Niraj assaulted Jewan Devi by labada all over her body on account of which she became unconscious and when Chottelal came to save them, accused persons also assaulted him.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against Suresh, while petitioner no. 2 (Niraj) along with Rajesh is alleged to have assaulted Jewan Devi. It is further submitted that Jawahir along with two others including Rajesh had approached this Court seeking anticipatory bail by filing Cr. Misc No. 37500 of 2026 and the same came to be allowed by an order dated 18- 6-2026 after considering the case in detail and on merits. It is also submitted that the case of the petitioner no. 2, if not akin, is similar to the case of the Jawahir and two others and petitioner no. 1 is on better footing.
5. Learned A.P.P. for the State, Ms. Gulnar Begum, opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned

order dated 18-6-2026 in Cr. Misc No. 37500 of 2026, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Majhauliya P.S. Case No. 864 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
