1. PATTIPATI KALYAN KUMAR Counsel for the Respondent(S):
1. PUBLIC PROSECUTOR The Court made the following: ORDER:
The instant Criminal Revision Case under Sections 438 & 442 of BNSS has been filed by the Petitioner seeking to set aside the Order dated 09.01.2026 passed in F.C.O.P.No.1315 of 2023 by the learned Additional Family Judge-cum-XIV Additional District and Sessions Judge, Vijayawada. 2
2. Petitioner was directed to pay Rs.10,000/- to Respondent No.2 towards costs tentatively to enable her to appear before this Court to defend the case. Inspite of the said direction, the Petitioner has not appeared before this Court. As such, this Court would like to dispose of the revision on merits. 3. This is a revision case filed against the order of maintenance passed in F.C.O.P.No.1315 of 2023 on the file of the Court of Additional Family Judge, Vijayawada. The trial Court vide order dated 09.01.2026 granted maintenance of Rs.17,000/- per month to Respondent No.2 / Wife. 4. The record would show that there is no dispute about the relationship between the parties. The impugned order would show that the Petitioner herein, who is the husband, is working as Junior Assistant in Zilla Parishad High School and earning Rs.42,000/- per month. Taking into consideration of the dependency of Respondent No.2 / Wife, income of the Petitioner and his obligation to maintain the wife, the learned trial Judge has rightly granted monthly maintenance of Rs.17,000/- to the wife to enable her to live on par with the status of the husband. In such circumstances, this Court does not find any warranting circumstances to interfere in the said order. 5. Accordingly, the Criminal Revision Case is dismissed. Pending applications, if any, shall stand closed. _________________________________________ Dr.JUSTICE VENKATA JYOTHIRMAI PRATAPA Date:01.04.2026 Dinesh
