Heard the learned counsel appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 22.06.2025 in connection with Daru P.S Case No. 65 of 2025 corresponding to G.R. Case No. 1758 of 2025 with reference to S.T. Case No. 361 of 2025, for the alleged offence registered under Sections 126(2), 115(2), 75(2), 76, 64(2), 62, 303(2), 351(2), 109(1) of the BNS, 2023 pending in the court of learned Additional Session Judge-IX, Hazaribagh. 3. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. 4. Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail and has submitted that there is direct and specific allegation of committing rape against the petitioner upon the victim and the motorcycle and other materials have been recovered from the place of occurrence. The victim has also supported the allegation made against the petitioner in her statement recorded under Section 183 of BNSS. 5. After hearing the learned counsel for the parties and considering the fact that there is direct and specific allegation made against the petitioner who is named in the FIR of committing forceful sexual assault against the victim, this Court is not inclined to enlarge the petitioner on bail. 2026:JHHC:19338 2 6.
