912 CRIMINAL WRIT PETITION NO. 780 OF 2021 4) It further appears that the informant-petitioner, pursuant to the said order, had filed the application before the concerned Sessions Judge for return the aforesaid gold and silver ornaments. However, the learned Sessions Judge rejected the said application on the ground that appeal filed by the State against the acquittal of the accused in the aforesaid Sessions Case is pending. 5) Learned APP submits that even today, the appeal filed by the State along with the application for condonation of delay is pending and is required to be heard on merits. He further submits that the muddemal articles may be required for inspection by this Court. 6) Under such circumstances, since the appeal is pending, the return of the muddemal articles, as directed by the Sessions Court, is subject to the decision in the appeal pending before this Court. In view of the same, we are not inclined to grant any relief in favour of the petitioner as prayed for. Accordingly, the criminal writ petition stands dismissed. Pending application, if any, stand disposed of.
