That the learned Rent Tribunal, without being influenced by the order passed by this Court as well as by the learned Rent Tribunal with regard to the maintainability of the pe- tition, shall decide the maintainability of the petition, particularly whether the petition filed by the landlord under Section 18 of the Rajasthan Rent Control Act, 2001 was maintainable or not. (ii). The learned trial Court will also be free to decide the issue as to whether Chapter II and III of the Rajasthan Rent Con- trol Act, 2001 are applicable or not, after recording the evidence of the parties.
