This is the second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 80/2025 registered at Police Station Basantpur, District – Balrampur - Ramanujganj (C.G.), for the offence punishable under Section 108 of the Bhartiya Nyaya Sanhita, 2023. 2. The earlier bail application of the applicant has been rejected by this Hon’ble Court vide order dated 19.01.2026 passed in MCRC No. 676 of 2026 on merits. 3. 2 committed suicide. It is the case of the prosecution that the deceased took this extreme step due to the fact that her marriage had been fixed with one Rajesh Kannojia, and the date of marriage was scheduled for
19.04.2025. It is alleged that the applicant, after coming to know about the said marriage on 02.04.2025, sent photographs of the deceased with him from their college days to Rajesh Kannojia and his family members. As a result, the deceased felt ashamed and embarrassed, and on 03.04.2025, she committed suicide by jumping into a well. 4. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that this is the second bail application of the present applicant and that, out of a total of 17 prosecution witnesses, only 9 have been examined, of which 8 witnesses have not supported the prosecution case. He also submits that the applicant has no criminal antecedents and has been in custody since 27.04.2025, and that the conclusion of the trial is likely to take some more time. Therefore, he prays for grant of regular bail to the applicant. 5. Learned counsel appearing for the State/non-applicant would oppose the bail application of the applicant. 6.
I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the above submissions, as the prosecution witness have been turned hostile, the same cannot be a ground for releasing the applicant on bail, therefore, I am not inclined to grant regular bail to the present applicant. 8.
