This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.172/2025 registered at Police Station Durg Kotwali, District- GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.03.27 12:53:33 +0530 2 Durg, Chhattisgarh for the offence punishable under Sections 21 (A), 27(A) of NDPS Act, 1985. 2. As per the prosecution story, on 22 April 2025, Inspector Vijay Kumar Yadav of Durg Kotwali Police Station received a tip-off that three persons Vishal Singh, Birendra @ Bira Pardhi, and Atul Kumar were selling a narcotic substance known as Chitta (Heroin) near Shivnath River, Mahamara Road, Municipal Corporation Room, Durg, for illegal profit. Acting on this information, the police conducted a raid, apprehended the suspects, and recovered 76.69 grams of Chitta (Heroin) from their possession. Further investigation revealed that the present applicant was also involved in the said crime. During the course of investigation, statements of the accused were recorded under Section 27 of the Evidence Act. Thereafter, the accused were charged with offences punishable under Sections 22(A) and 27(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985. The applicant was arrested on 25 April 2025 by Durg Kotwali Police Station, District Durg, Chhattisgarh, for the alleged offences punishable under Sections 22(A) and 27(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 06/11/2025 in MCRC No.8839/2025. He would submit that after rejection of the 3 first bail application, all the co-accused persons involved in the present crime have been granted bail by this Court. He would submit that co-accused Lavprit Singh Urf Vicky and Vikramjeet Singh Urf Vicky have been granted bail vide order dated 14.01.2026 passed in MCRC No. 8910/2025, co-accused Vishal Singh has been granted bail vide order dated 14.01.2026 passed in MCRC No.9291/2025, and co-accused Atul Kumar has been granted bail vide order dated 05.02.2026 passed in MCRC No.1287/2026. He would submit that the learned Trial Court has already framed charges against the accused persons on 05.01.2026. He would submit that charge-sheet has already been filed in the present case, the applicant is in jail since 25/04/2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application. She would submit that the applicant has one previous criminal antecedent under the NDPS Act which is pending, as such he is a habitual offender and is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 06/11/2025 in MCRC No.8839/2025 on the ground that the applicant had one 4 previous criminal antecedent under the NDPS Act, which is still pending. No new ground has been raised in this second bail application to entertain the same. 7. Accordingly, the second bail application of the applicant- Harpal Singh, involved in Crime No.172/2025 registered at Police Station Durg Kotwali, District- Durg, Chhattisgarh for the offence punishable under Sections 21 (A), 27(A) of NDPS Act, 1985, is rejected. 8.
