KAMAL ORAL ORDER Petitioner claiming to be the absolute owner and in possession and enjoyment of the land bearing Sy.No.77/7 measuring 30 guntas and Sy.No.77/8 measuring 1 acre situated at Heggondanahalli Village, Sarjapura Hobli, Anekal Taluk, Bengaluru is before this Court being aggrieved by the order dated 21.03.2023 passed by the respondent No.1 produced at Annexure-A. 2. By the impugned order respondent No.1/ Commission has gone into the validity or otherwise of the purchase of the property made by the petitioner and has further proceeded to question the revenue proceedings initiated in RRT.CR/493/21-22 and consequent order passed thereon. - 4 - HC-KAR NC: 2026:KHC:25812 WP No. 18528 of 2023 Respondent No.1 / Commission has consequently directed for cancellation of mutation/Katha entry of the petitioner in respect to said property and to restore the said property in favour of the private respondents. 3. Learned counsel for the petitioner relying upon the judgment of the Coordinate Bench of this Court in the case of M.B.Siddalingaswamy vs. State of Karnataka, Department of Education (Primary and Secondary), represented by its Principal Secretary and others reported in 2020 SCC Online Kar. 4968 as well as in the case of Ganganna v. State of Karnataka represented by its Principal Secretary, Department of Revenue and others reported in 2020 SCC Online Kar. 4967 submits that the Respondent No.1-Commission has no jurisdiction to pass the impugned order, as no such power or authority is vested in it under the Karnataka State Commission for the Scheduled Castes and Scheduled Tribes Act, 2002. Thus, he submits the order passed being one without jurisdiction, is required to be quashed. - 5 - HC-KAR NC: 2026:KHC:25812 WP No. 18528 of 2023 4. Learned AGA do not dispute the aforesaid position of law. He adds, however, the Commission at the most can make recommendation. 5. Submission is placed on record. 6. In the light of the issue involving this petition having been covered by the judgments of the Coordinate Bench of this Court as noted above, petition is allowed.
