KAMAL ORAL ORDER Petitioner who had availed the financial assistance from the respondents-Bank is before this Court seeking following reliefs; "a) Issue a Writ in the nature of Writ of Mandamus, direct the Respondents Bank to pay Insurance amount of Rs.15,00,000/-, along with interest to the Petitioner herein through the Insurance Company, as agreed by the Respondents Bank at the time of availing the Insurance Policy. b) Issue a Writ of Mandamus or any other Writ, directing the Respondents Bank to return the original property documents of the Petitioner forthwith to the Petitioner without any delay. c) Issue such other Writ or order or direction as this Hon'ble Court deems fit under the facts and circumstances of the case including an order as to cost in the interest of justice and equity." 2. Though the notice of this petition has been served on the respondents, there is no representation. 3. Learned counsel for the petitioner submits that the petitioner has repaid the entire loan amount under OTS and - 3 - HC-KAR NC: 2026:KHC:25811 WP No. 58 of 2022 despite receipt of the same the respondent -authorities have not returned the original documents. 4. He draws attention of this Court to the representation dated 01.07.2021 followed by a legal notice dated 07.09.2021 as per Annexures- K and L respectively and submits despite the said representation and the notice, respondents have remained defiant. He submitted petition has no efficacious remedy but to seek necessary directions against the respondents. 5. Since learned counsel for the petitioner has submitted, the petitioner has repaid the entire loan amount, under the circumstances this Court deems it appropriate to show indulgence to the limited extent directing the respondents-Bank to consider the representation of petitioner dated 01.07.2021 produced at Annexure- K and communicate its response thereof in writing within an outer limit of 8 weeks from the date of receipt of the certified copy of this order.
