Petitioners who are apprehending arrest in Crime No.326/2020 registered by Davanagere Rural Police Station, Davanagere, for the offences punishable under Sections 406, 409, 420, 465, 468, 471, 34 IPC, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the petitioners and the learned Addl. SPP on behalf of the respondent-State. 3. Petitioners who had received inquiry notice issued under Section 35(3) of BNSS 2023 in Crime No.326/2020, apprehending arrest in the said case had filed Crl. Misc. - 3 - HC-KAR NC: 2026:KHC:25881 CRL.P No. 6340 of 2026 No.206/2026 before the jurisdictional Sessions Court which was rejected on 08.04.2026. It is under these circumstances, petitioners are before this Court. 4. Perusal of the material on record would go to show that first information in the present case is registered as against the staff of UCO Bank and three others for the aforesaid offences. The accused who are named in the FIR have been granted anticipatory bail by this Court in Crl.P.No.10312/2023, Crl.P.No.5411/2023 and Crl.P.No.6468/2023. It is brought to the notice of this Court that though first information has been registered in the present case in the year 2020 itself, no charge sheet is filed till date. 5. This Court by order dated 27.04.2026 has granted interim bail to the petitioners herein subject to conditions. 6. Learned Counsel for the petitioners has submitted that pursuant to the interim bail granted to the petitioners in the present case, they have participated in the investigation and he also submits that petitioners are ready and willing to co- operate with the police for the purpose of further investigation - 4 - HC-KAR NC: 2026:KHC:25881 CRL.P No. 6340 of 2026 and they shall appear before the Investigation Officer as and when required. He further submits that petitioner no.2 is a aged lady, and therefore, her presence before the Investigation Officer may be exempted unless specifically required. 7. The alleged offences are all triable by the Court of Magistrate and the maximum punishment for the same is imprisonment for a period of seven years. Undisputedly, petitioners have no criminal antecedents. Since the petitioners have already participated in the investigation and co-operated with the Investigation Officer, I am of the opinion that their prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 8. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of their arrest in Crime No.326/2020 registered by Davanagere Rural Police Station, Davanagere, for the offences punishable under Sections 406, 409, 420, 465, 468, 471 read with 34 IPC, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer and shall execute a personal - 5 - HC-KAR NC: 2026:KHC:25881 CRL.P No. 6340 of 2026 bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
