2. This is an application under section 528 of the BNSS, 2023 challenging the order dated 30.03.2024 passed by the learned Sessions Judge, Jorhat in Sessions Case No.145/2018 arising out of G. R. Case No.2254/2018.

3. The petitioner has been facing the trial before the Court below. On some dates he was absent without steps and therefore, Non-Bailable Warrant of Arrest (hereinafter in short referred to as “NBWA”) was directed to be issued against him.
4. Mr. Ahmed submits that the petitioner is the resident of Dhubri town and he has to go all the way to Jorhat to attend the trial. During the COVID period, the petitioner could not go to Jorhat to attend the trial and as a result of which, NBWA was issued against him.
5. Mr. Ahmed has submitted that the petitioner is interested in facing the trial and therefore, he deserves to be given adequate opportunities to that effect. Therefore, all orders directing issue of NBWA against him is in Sessions Case No.145/2018 pending in the Court of the learned Sessions Judge, Jorhat in Sessions Case No.145/2018 arising out of G. R. Case No.2254/2018 are set aside.
6. I have considered the submissions made by the learned counsel for the petitioner.
7. The petitioner Sofikul Hoque Alias Md. Safiqul Haque is directed to appear before the trial court within next 10 days from today. On his appearance, the petitioner Sofikul Hoque Alias Md. Safiqul Haque shall be released on fresh bail of ₹20,000/- (Rupees Twenty Thousand) with a surety of like amount to the satisfaction of the learned Sessions Judge, Jorhat. With the aforesaid direction, this Criminal Petition stands disposed of.
