JUSTICE S VISHWAJITH SHETTY ORAL ORDER The accused in Crime No. 91/2025 registered by Thirumani Police Station, Tumakuru, for the offences punishable under Sections 303(2), 62 of the Bharatiya Nyaya Sanhita (BNS), 2023 (hereinafter referred to as 'BNS, 2023' for short) is before this Court in this criminal petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard the learned counsel appearing for the petitioner and the learned Additional SPP appearing on behalf of the respondent/State. 3. FIR in Crime No. 91/2025 was registered by the Thirumani Police Station, Tumakuru, for the aforesaid offences against the petitioner based on the first information dated 21.12.2025 received from - 3 - HC-KAR NC: 2026:KHC:26010 CRL.P No. 1448 of 2026 Ramanjineyulu. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.5001/2026 before the jurisdictional Sessions Court which was rejected on 12.01.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that the articles of which theft was allegedly committed have been recovered in the present case. Petitioner has no other criminal antecedents and he undertakes to co-operate with the police. 5. Learned Additional SPP has opposed the petition. 6. Perusal of the first information would go to show that allegation against the petitioner is that he had committed theft of 3 tracker link tubes belonging to the company known as 'KEC Solar Company', in which the first informant was working as a field officer. In the first information itself it is mentioned that after the petitioner had seen the staff of the aforesaid company, he had ran - 4 - HC-KAR NC: 2026:KHC:26010 CRL.P No. 1448 of 2026 away from the spot leaving behind the articles which allegedly were stolen by him. Undisputedly petitioner has no other criminal antecedents. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the same is imprisonment for a period of 3 years. Petitioner has undertaken to cooperate with the police for the purpose of investigation. 7. Under the circumstances, the following order: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No. 91/2025 registered by Thirumani Police Station, Tumakuru, for the offences punishable under Sections 303(2), 62 of the BNS, 2023, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:26010 CRL.P No. 1448 of 2026 1. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (one lakh only) with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co- operate with the police for investigation and appear before them whenever called upon. 4.
