JUSTICE RAHUL BHARTI, JUDGE. ORDER 10.07.2026 1. The two petitioners are daughters of the respondent No. 7- Sh. Jungbahadur Singh and granddaughters of the respondent No. 8- Smt. Inder Kour. 2. The respondent No. 8 joined by her two sons namely Parampal Singh and Trilok Singh have initiated a civil suit for permanent prohibitory injunction before civil court of learned Sub Judge, Baramulla against five defendants namely Smt. Rajinder Kour, Sh. Tarandeep Singh, Smt. Gagandeep Kour, Sh. Amandeep Singh and Sh. Ranbadur Singh. The two petitioners herein figure as the defendants No. 3 and 2 in the said suit. Sr. No. 142 Supp. 1 3. During the pendency of said civil suit, the very act of the petitioners in coming to this Court with a writ petition under Article 226 of the Constitution of India with a purported prayer of direction unto the official respondents to take all lawful and appropriate measures for preservation, protection and safeguarding of existing physical condition of the ancestral residential house of the petitioners situated at village Uplana District Baramulla allegedly illegally damaged by the respondent No. 7 and 8 is nothing but an attempt to overreach the civil court seized of the litigation between the petitioners and the respondent No. 8 in particular. 4. Entertainment of such like writ petition would be nothing but an encouragement to frivolous litigation. As such, this writ petition is dismissed. 5. A copy of this order be forwarded to court of learned Sub Judge, Baramulla by the learned Registrar Judicial, Srinagar for being taken on record of suit file.
