JUSTICE JAYANT BANERJI) When the matter was last listed on 07.01.2026, the following order was passed: “It is stated at the Bar that the appellant is a liability partnership firm under winding up and a Liquidator under the provisions of Limited Liability Partnership Act, 2008 has already been appointed and to whom notice has been issued by an order of the Court dated 19.10.2022. We notice from the office report that the notice was issued to the Liquidator namely, Mr. Kondisetty Kumar Dushyantha. But neither the unserved cover nor the acknowledgement received and the tracking report of the India Posts Service reflects that the item was delivered on 26.11.2022, as such, notice on the Liquidator is sufficient. However, we find that in the cause list the name of the Liquidator is not reflected. As such, the office is directed to list this matter in the next week showing the name of Mr. Kondisetty Kumar Dushyantha as the Liquidator against the name of the appellant appearing in the cause list. It is however informed that winding up of the LLP-petitioner would take place under the provisions of the Insolvency and Bankruptcy Code, 2016.” 2. As is evident from the aforesaid, notice on the liquidator is sufficient. Today, Sri.Kondisetty Kumar - 4 - HC-KAR NC: 2026:KHC:26017-DB WA No. 1049 of 2019 Dushyantha's name as the liquidator appears on behalf of the appellant in the cause list. 3. Despite the matter being called out twice, no one appears for the appellant. The appeal is dismissed for non-prosecution.
