JUSTICE SANJAY KUMAR DWIVEDI For the Petitioners :Mr. Pran Pranay, Advocate For the State : Mrs. Amrita Sinha, A.P.P For the Informant : Mr. Jitendra Shankar Singh, Sr. Advocate 02/ 02.07.2026: Heard learned counsel for the petitioners and learned counsel for the State and learned senior counsel for the informant. 2. The petitioners are apprehending their arrest in connection with Telco P.S. Case No. 110 of 2025 registered under sections 352, 74, 79, 126, 115(2), 118(2), 109, 3(5) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Ist Class, Jamshedpur. 3. Learned counsel for the petitioners submits that so far petitioners are concerned, there are only allegation that petitioners reached at the spot on the call made by Rohit. He next submits that petitioners are father and uncle of Rohit. He further submits that there are case and counter case between the parties and petitioners side also received injury and for the same incident case has been lodged by the petitioners side. He next submits that apart from that there is no allegation against the petitioners and the allegation of assault is there against Rohit @ Kacha and Roshan Kumar. He submits that petitioners have no criminal antecedent which is disclosed in para 16 of the the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. ( 2026:JHHC:19335 ) 4. Learned counsels for the State and informant jointly oppose the prayer and submits that serious allegations are there in the F.I.R that Rohit @ Kacha and one another boy was teasing the informant and when she has resisted then they called the petitioners and pursuant to that petitioners arrived and arms have been provided and thereafter assault has been made and in view of that anticipatory bail of the petitioners may kindly be rejected. 5. On perusal of F.I.R, it transpires that allegation of teasing is there against Rohit @ Kacha and Roshan Kumar and allegation of molestation is also there against Rohit @ Kacha and Roshan Kumar and when the informant called her mother and father thereafter Rohit has further called the petitioners and allegations are made that the petitioners arrived at the spot. Further allegation of assault is there against Rohit @ Kacha and Roshan Kumar pursuant to that grievous injury has been received by mother and brother of the informant. The mother of the informant Shobha Devi has given statement under section 180 of BNSS which is part of case diary and she has also stated that Roshan Kumar assaulted by way of sword and Rohit @ Kacha has assaulted her son by way of farsa. Thus, it is crystal clear that allegations of assault are there against Rohit @ Kacha and Roshan Kumar and not against the petitioners. The petitioners are father and uncle of Rohit and there are case and counter case. The petitioners have no criminal antecedent which is disclosed in para 16 of the petition. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to ( 2026:JHHC:19335 ) the satisfaction of learned Judicial Magistrate, Ist Class, Jamshedpur, in connection with Telco P.S.
