Learned counsel for the petitioner submits that the present execution petition has been rendered infructuous inasmuch as on an earlier occasion i.e. 28.02.2023, the petitioner had to furnish requisite surety bonds to the satisfaction of the Registrar (Judicial) for the release of the amount deposited by the State. The Order dated 28.02.2023, reads as under:-
“Heard. The amount in question was earlier credited by the respondents / State in the account of the applicant / petitioner. However, at the asking of the respondents / State, applicant / petitioner had refunded the amount in question to the State. Now the State has gone up in an appeal before the Hon’ble Supreme Court against the order passed

26.11.2021. Now the State has deposited the amount in question with the Registry. The amount deposited by the State be released to the applicant/petitioner. Learned Additional Advocate General on the other hand has opposed the application. Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the amount deposited by the State to the applicant by remitting the same in his bank account, disclosed in para-7 of the application, subject to furnishing requisite surety bounds by the applicant/petitioner to the satisfaction of the Registrar (Judicial). Application stands disposed of accordingly.”
