LISA GILL,J.
This writ petition has been filed for setting aside notice dated 22.07.2025 under Section 13(2), 05.12.2025 under Section 13(4) of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short “SARFAESI Act”) as well as Sale Proceedings dated 29.12.2025 and any further proceedings undertaken by respondent-Bank against the petitioners.
2. It is a matter of record that S.A No.6 of 2026 filed by petitioners is pending adjudication before the learned Debt Recovery Tribunal, Visakhapatnam.
3.
Learned counsel for petitioners informs that I.A No.225 of 2026 has been filed for stay of proceedings initiated by the Bank for sale of scheduled property but the same has now been posted to 15.04.2026. In the meanwhile, respondent-Bank, it is submitted shall proceed with auction of the property which shall lend grave prejudice to petitioners.
4. It is contended that petitioner No.1 is registered under Micro, Small and Medium Enterprises Development Act. Proper procedure for carrying out proceedings under SARFAESI Act was not carried out by respondent-Bank. Entire proceedings are thus vitiated.
5. We have heard learned counsel for petitioners, but do not find any ground to cause interference at this stage and especially keeping in view the pendency of S.A No.6 of 2026 as well as I.A No.225 of 2026 filed by petitioners. Arguments as raised before us are very well within the realm of

consideration by the learned Debt Recovery Tribunal. It is a settled position that in matters like present interference in exercise of jurisdiction under Article 226 of Constitution of India has to be minimal and actuated only in exceptional or extraordinary circumstances.
6. Petitioners are at liberty to file appropriate application for pre-ponement of hearing before learned Debt Recovery Tribunal, in case of any urgency as is sought to be projected before us.
7. Writ petition is, accordingly, disposed of without expression of any opinion on the merits of the matter, with liberty to petitioners to take appropriate steps and pursue the matter before learned Debt Recovery Tribunal while urging all available pleas. No costs. Pending application(s), if any, stand(s) disposed of accordingly.
