1. This Court is not convinced that Mr. Mohammad Ashraf Bhat is coming up with a genuine representative character and antecedents to represent the inhabitants of village Bomai, Sopore to complain against encroachment of a common pathway and seeking its restoration otherwise the first thing to be done in alleged state of circumstances related to encroachment of a common pathway is an immediate representation to the Deputy Commissioner, Baramulla drawing his attention to the objectionable state of affairs and seeking his administrative interference and indulgence being vested not only with the revenue side jurisdiction but also with the magisterial power to ensure that Sr. No. 144 Supp. 1
common pathways do not suffer any encroachment but without bothering himself to go to the Deputy Commissioner, Baramulla coming up with representative writ petition in the High Court of J&K and Ladakh, Srinagar Wing is nothing but a flight of fancy on the part of Mohammad Ashraf Bhat.
2. As such, this Court is not inclined to give indulgence in CM No. 4127/2026 whereby leave of this Court is being solicited for maintaining the writ petition in a representative capacity.
3. Thus, the writ petition is not entertained without prejudice to the right of Mohammad Ashraf Bhat as a purported representative of village Bomai to approach Deputy Commissioner, Baramulla for his indulgence, which if sought be granted by a proper inquiry into the matter.
4. Disposed of.
