( 2026:JHHC:19200 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 5978 of 2026 ------ Rishi Kumar, aged about 28 years, Son of Bhola Ram, Resident of Ambedkar Nagar, Gadi Khana, Near Old Bus Stand, P.O. and P.S. –Hazaribagh, District –Hazaribagh. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. A.K. Chaturvedy, Advocate For the State : Mr. Sahilesh Kr. Sinha, Addl. P.P. ------ Order No.02 Dated- 01.07.2026 Heard the parties. The petitioner has been made accused in connection with Lohsinghna P.S. Case No.28 of 2026 registered for the offences punishable under Section 103 (1) and 61 (2) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in criminal conspiracy with the co-accused persons, committed murder of Abhishek Kumar. It is submitted that the allegation against the petitioner is false. Drawing attention of the court to para -52 of the case-diary, learned counsel for the petitioner submits that Sonu Kumar who saw the C.C.T.V. footage, has categorically stated that Vijay Kumar Vinayak was holding a knife and the co-accused Shyam Kumar was holding a sword and both of them assaulted Abhishek Kumar twice with their respective weapons and a pointed sharp weapon pierced through the right chest of Abhishek Kumar. It is next submitted that the only allegation against the petitioner is that the petitioner was present at the place and admittedly at the time of occurrence, the procession of Ramnavami was going on, so, merely the presence of the petitioner at the place of occurrence is not a sufficient ground to implicate him in this case. Drawing attention of this Court towards para-20 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is next submitted that the petitioner has been in custody since 04.04.2026 as has been mentioned in para-21 of the instant bail application. It is lastly submitted that the co-accused person has already been admitted to bail by this Court vide order dated 17.06.2026 in B.A. No. 5379 of 2026. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Hazaribagh in connection with Lohsinghna P.S. Case No.28 of 2026 with the condition that he will cooperate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
