JUSTICE BISWAJIT PALIT Order 25/02/2026 Heard Learned Counsel, Mr. Ratan Datta appearing on behalf of the accused-in-custody and also heard Learned P.P., Mr. Raju Datta appearing on behalf of the State-respondent. This bail application under Section 483 of BNSS corresponding to Section 439 of Cr.P.C. is filed for granting bail to the accused-in-custody in connection with Ganganagar P.S. case No.2023/GNR/006 corresponding to Spl(NDPS) No.12 of 2025. At this stage, Learned Counsel for the accused-in- custody drawn the attention of the Court that in this case, trial is completed and the case is now posted for hearing of argument on 27.02.2026 and during the trial, prosecution could not adduce convincing materials to justify conviction against the accused. So, 2 Learned Counsel urged for releasing the accused on bail in any condition. It was further submitted that earlier one bail application bearing B.A. No.84 of 2025 was moved which was dismissed by this Court by order dated 25.09.2025. At this stage, Learned P.P. submitted that since the case is posted for argument, so, a direction may be given to Learned Trial Court to complete the trial within a short period and further prayed to dismiss the bail on that ground. Since the trial is almost completed and the case is now posted for hearing of argument on 27.02.2026, so, if at this stage, the matter is heard and any observation is given regarding the evidence on record, that may affect the merit of the case. Situated thus, I am not inclined to entertain the bail application filed by the applicant at this stage. Accordingly, the same is rejected. However, it is directed that as the recording of evidence is completed and it is expecting that the hearing of the case will be held on 27.02.2026, so, all endeavour shall be made by the Learned Trial Court to dispose of the case preferably within a period of 1(one) month from the date of receipt of the copy of order. With this observation, this present bail application stands disposed of. Registry be asked to send down the record to the Learned Trial Court along with a copy of this order by Special Messenger positively by tomorrow since the date is fixed day after tomorrow.
