Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has assailed order dated 10.02.2026 (Annexure P-2), in terms whereof, she has been transferred from the Office of SDO (Civil), Paonta Sahib, District Sirmour, H.P. to Patwar Circle Saraswati Nagar, Sub-Tehsil Sarswati Nagar, District Shimla, H.P. in place of the private respondent. 2. The submission of learned Counsel for the petitioner is that the transfer has been effected just to adjust the private respondent and therefore, the same is bad in law. 3. Learned Additional Advocate General and Learned Counsel for respondent No.3 point out that the petitioner has completed more than three and half years at Paonta Sahib and the post of Patwari now being a State Cadre Post, the petitioner cannot say that the impugned transfer order is bad. 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:5684 4. Learned Counsel for the petitioner submits that the petitioner has three minor children to look after and she also has some medical problem on account whereof, she is praying for cancellation of her transfer order. 5. Having heard learned Counsel for the parties and in light of the fact that the petitioner has completed normal tenure at the present place of posting, without interfering with the impugned transfer order, this petition is disposed of with the direction that the petitioner may represent to the Authorities concerned for her adjustment at some other place and in the event of any such representation being filed within a period of 10 days from today, let appropriate decision thereupon be taken within a period of two weeks as from the date of receipt of the same after hearing the petitioner. Till then, the interim protection granted to the petitioner by this Court shall continue. It goes without saying that in case the petitioner does not file any representation within the time granted by this Court, then this order shall be rendered otiose and interim protection granted to the petitioner shall also seize forthwith.
