This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.52/2026 registered at Police Station – Lailunga, District-Raigarh (C.G.) for the offences punishable under Sections 4, 6, 10 and 11 of Agricultural Cattle Preservation Act, 2004 and Section 11 of Prevention of Cruelty to Animals Act. 2. Prosecution case in brief is that 17.02.2026 information was received by police station Lailunga through an informant that some persons are taking animals towards Odisha to slaughter house, that VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.27 14:39:20 +0530 2 thereafter the police authorities when to village Jhagarpur whereby the stopped some persons namely Dewanand Yadav who was taking some animals without there being any legal documents with him moreover the accused person failed to show any documents with regard to possession of animals, hereafter the FIR was register an investigation was initiated by police. 3. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. He would submit that applicant not even the present at the time of incident, only on the basis of memorandum statement of the co- accused, present applicant falsely implicated in crime in question and because of the prior dispute of the police authorities. Further more investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that applicant has four previous criminal antecedent bearing crime Nos. 225 of 2023 and 41 of 2026 of similar nature and two other antecedents bearing crime Nos.103 of 2024 and 41 of 2024 of IPC, it appears that applicant is a habitual offender and he misuse the liberty granting him earlier, therefore, he is not entitled to be granted anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties, allegation levelled against the applicant and also considering the fact that 3 applicant has four previous criminal antecedent bearing crime Nos. 225 of 2023 and 41 of 2026 of similar nature and two other antecedents bearing crime Nos.103 of 2024 and 41 of 2024 of IPC, it appears that applicant is a habitual offender and he misuse the liberty granting him earlier, as such, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Rabbul Khan filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.52/2026 registered at Police Station – Lailunga, District-Raigarh (C.G.) for the offences punishable under Sections 4, 6, 10 and 11 of Agricultural Cattle Preservation Act, 2004 and Section 11 of Prevention of Cruelty to Animals Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
