The applicants have preferred this First bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 65/2025, registered at Police Station – Singhoda, District: Mahasamund (C.G.) for offence punishable under Sections 281, 125 (1), 303 (2), 3 (5) of BNSS and Section 20 (B) ii (b), 29 (1) of NDPS Act and Section 25 of the Arms Act. 2. The brief case of the prosecution is that on 07.08.2025, the police received information that a Scorpio vehicle bearing registration No. CG- 12-DX-4655 was being driven in a rash and negligent manner and met with an accident with a Splendor motorcycle, as a result of which the motorcycle rider, Digambar Patel, sustained injuries. Subsequently, an Ertiga vehicle bearing registration No. CG-04-LM-0358 was found escorting the said Scorpio vehicle. It is further alleged that nine goats, which were stolen from Village Melchhamuda, Odisha, and were being transported to Bilaspur, were recovered from the Scorpio vehicle. Additionally, 30 kg of ganja was also seized. Thereafter, a report was lodged, and the present applicants were arrested. 3. Learned counsel for the applicants would submit that the applicants are falsely implicated in the matter as they were not present in the spot. He further submits that the applicants are young boys aged 22, 22 and 25 respectively and they are in jail since 07.08.2025, therefore, they may be enlarged on bail. 4. Per contra, learned State counsel opposes the prayer for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary along with the charge-sheet with utmost circumspection. 6. Considering the entire facts and circumstances of the case, the nature 3 of the allegations, and the submissions made by the learned counsel for the parties, this Court finds no merit in the present application. The record indicates that 30 kg of Cannabis a commercial quantity was seized from the joint possession of the applicant and other co-accused persons. Furthermore, the applicant is named in the FIR, and a mobile phone was recovered from his possession. While the contraband was found in a Scorpio (bearing No. CG 12 DX 4655), the applicant is alleged to have been piloting the vehicle. Given the commercial quantity of the contraband and the evidence of joint possession, I am not inclined to grant bail to the applicant. 7. Accordingly, the bail application is rejected.
