This Writ Petition under Article 226 of the Constitution of India has been filed for the followings reliefs:- "10.1 That, this Hon'ble Court may kindly be pleased to issue a suitable writ, order directing the respondent authorities to grant Digitally signed by AJAY KUMAR DWIVEDI DN: cn=AJAY KUMAR DWIVEDI, ou=HIGH COURT, o=HIGH COURT OF CHHATTISGARH, st=Chhattisgarh, c=IN Date: 2026.03.20 17:22:04 +0530 2 benefit of the compensation of the acquired land of the petitioner, which acquired in pond. 10.2 That, this Hon'ble Court may kindly be pleased direct the respondents to pay fair compensation to the petitioner for the land bearing Khasra No. 408/4 admeasuring 0.0560 hectare which has been utilized for the construction of the pond, with Interest of 9% per annum from the date of taking possession till expiry of one year; and Interest of 15% per annum thereafter till actual payment of the entire compensation amount, with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. 10.3 Any other relief which this Hon'ble Court deems fit and proper may also be passed in favour of the petitioner together with cost of the petition." 2. Learned counsel for the petitioner submits that the petitioner is recorded owner of land bearing Khasra No.408/4, Area 0.0560 hectare situated at Village Sardhabhatha, Tahsil Dharsiwa, District Sarangarh-Bilaigarh. He further submits that without following due process of law the respondents/Authorities have constructed pond in his land for public purpose but no compensation has been given to the petitioner. He has also made representation dated 17.03.2025 (Annexure-P/2) before the respondents/Authorities raising his grievances but same has not been decided yet. Hence, he prays that, at this stage, this may be disposed of directing respondent No.2 to decide his representation within stipulated time-frame. 3. Learned State counsel submits that representation of the petitioner will be decided in accordance with law. 3 4. Having considered the limited prayer of the petitioner and considering the facts of the case, respondent No.2-Collector, Sarangarh-Bilaigarh is directed to get demarcation of the land of the petitioner within a period of 30 days from the date of receipt/submission of copy of this order. Further, if it is found that land of the petitioner has been utilized for construction of pond for public purpose then, the Collector shall decide representation of the petitioner and shall also proceed to provide appropriate compensation to the petitioner after following due process of law.
