THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The father of the convict Naveen N. D. @ Subsidy Naveena (CTP No.01173) is before this Court seeking for the following reliefs: a) Issue a Writ of Mandamus or other appropriate writ or order seeking a direction to Respondent No.2 to release the convict prisoner, Naveen N.D. @ Subsidy Naveena [CTP No.01173) on emergency parole for a period of 90 days in terms of representation dated 27.03.2026, vide ANNEXURE-D. b) Issue a Writ of Mandamus or other appropriate writ or order seeking a direction to Respondent No.3 to release the convict prisoner, Naveen N.D. @ Subsidy Naveena [CTP No.01173] on emergency parole for a period of 90 days in terms of representation dated 27.03.2026, vide ANNEXURE- D1. c) Pass any such other order/s as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice & equity. 2. Petitioner is the father of the convict Naveen N. D. @ Subsidy Naveena (CTP No.01173) who had been - 3 - HC-KAR NC: 2026:KHC:26062 WP No. 10682 of 2026 convicted for imprisonment for life by the Sessions Court in SC No.175/2022 vide judgment dated 18.12.2024 for offences under Section 302 read with Section 120B of the Indian Penal Code. The convict has been in judicial custody from 10.02.2022 till the date of conviction and thereafter transferred from District Prison, Hassan to Central Prison, Mysore on 19.12.2024. The total period of incarceration as on date is a little over 4 years. 3. The submission of the learned counsel for the petitioner is that the petitioner's father who is the grandfather of the convict is aged about 97 years and on his death bed and for that reason, the petitioner wishes for the convict to be available at this point of time with the grandfather. 4. On enquiry learned HCGP submits that the convict had been released on parole on three earlier occasions i.e., the first time for 30 days on 06.05.2025, second time for 15 days on 24.07.2025 and the third time for 15 days on 10.10.2025 and during the release on parole on all those times there is no complaint against the convict and the convict has surrendered to the jail authorities after the completion of the period of parole. On enquiry, he - 4 - HC-KAR NC: 2026:KHC:26062 WP No. 10682 of 2026 submits that the conduct of the convict during the incarceration is satisfactory and there are no complaints in relation thereto. 5. Considering that the convict had been released on parole on three earlier occasions when there were no complaints and that the reason which has now been attributed for parole is the ailment of the grandfather, I am of the considered opinion that the convict could be released on emergency parole for a period of 15 days commencing from 05.06.2026. Hence, this Court passes the following: ORDER i. The Writ Petition is allowed. ii. Respondent No.3 - the Superintendent, Central Prison, Mysore, is directed to release convict - Naveen N. D. @ Subsidy Naveena (CTP No.01173) on emergency parole for a period of 15 days commencing from 05.06.2026, subject to the following conditions. a) The convict (CTP No.01173) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to - 5 - HC-KAR NC: 2026:KHC:26062 WP No. 10682 of 2026 take him to gaol, in the event, the convict (CTP No.01173) would evade going back to the gaol, after the expiry of the period of emergency parole. b) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the convict to the gaol and that he shall not commit any other offence during the period of parole. iii.
