Petitioner has filed this writ petition seeking following reliefs: “1. That this Hon'ble Court may kindly be pleased to issue a writ in the nature of Mandamus commanding the respondents to produce the entire record leading to issuance of this Hon'ble Court. 2. That this Hon'ble Court may kindly be pleased to issue a Writ nature of certiorari quashing the impugned transfer order Annexure P-1.” 2. Learned counsel for the petitioner submits that the petitioner while working on the post of Deputy Forest Ranger has been promoted to the post of Forest Ranger vide order dated 21.11.2025. Petitioner has joined the promotional post and within short period of about 2 months he was again posted in the office of Karya Aayojna Forest Division Jagdalpur. It is contention of learned counsel for the petitioner that petitioner is due to retire on 31st January 2027 i.e within period of less than one year . He also contended that to resolve such grievance of employees from their shifting from one place to another, State Govt. has made provision under Transfer Policy not to transfer the employees who are remaining less than one year of service for retirement and therefore also impugned order of posting of petitioner requires to be interdicted. 3. Learned counsel for the State submits that shifting of petitioner from one place to another by order Annexure P-1 is not by way of transfer but by way of promotion. He however submits that pursuant to observation made by this Court on the last date of hearing he has sought instruction from the higher official and he was informed that if 3 / 3 petitioner submits representation before respondent No.1 his representation will be considered. 4. At this stage learned counsel for the petitioner would submit that petitioner may be permitted to submit representation before respondent No.1 and a direction be issued to respondent authority to consider and take decision on representation at the earliest within shortest possible time. 5. On due consideration of submission of learned counsel for the respective parties and considering nature of grievance as raised in this writ petition, this writ petition is disposed of permitting the petitioner to submit representation before respondent No.1 within a period of 10 days and if such representation is submitted concerned authority shall take decision on the representation within a further period of 2 weeks from the date of receipt of representation in an objective manner sympathetically. 6. At this stage, learned counsel for the petitioner submits that petitioner till date has not been relived from present place of posting and therefore some protection may be granted. 7. Considering the submission of learned counsel for the petitioner, it is directed that no coercive steps shall be taken against the petitioner till decision on his representation to be submitted before the authority.
