JUSTICE S.G.PANDIT) The petitioner is before this Court questioning non- grant of interim order by the Karnataka State Administrative Tribunal at Bengaluru (for short, ‘the Tribunal’) in Application No.2641/2026 whereunder the petitioner had questioned the notification dated 14.05.2026 transferring the petitioner and posting her to Urban Development Department while posting respondent No.3 to her place. - 3 - HC-KAR NC: 2026:KHC:25473-DB WP No. 16080 of 2026 2. Heard learned counsel Sri.Satish.K., for petitioner and learned Additional Government Advocate Sri.K.R.Rajendra for respondent Nos.1 and 2. Perused the entire material on record. 3. The Tribunal while refusing to grant interim prayer of the petitioner has noted that the private respondent has assumed the charge before relieving the applicant from the present post by virtue of impugned notification dated 14.05.2026. From the papers made available with the writ petition, it is seen that respondent No.3 who entered Caveat has produced three documents i.e., notification dated 14.05.2026 posting respondent No.3 in the petitioner’s place as well as movement order dated 14.05.2026 whereunder respondent No.3 was relieved from her post and permitted to report to duty at the transferred place. When respondent No.3 assumed change on receiving movement order dated 14.05.2026, - 4 - HC-KAR NC: 2026:KHC:25473-DB WP No. 16080 of 2026 we would not find any error in the observation and the order passed by the Tribunal. 4. Learned counsel for the petitioner would submit that by the time application is taken up for hearing, petitioner would have completed her tenure, as such, he seeks for a direction to the Tribunal to dispose of the application early. 5. In the above background, it is for the petitioner to request the Tribunal to take up the matter for hearing early. If such request is made, we are sure the Tribunal would take up the matter for early disposal. 6. Learned counsel for the petitioner also contended that the petitioner is transferred without giving any posting and in that regard, petitioner brought to the notice of the Tribunal, the decision of the Division Bench of this Court in W.P.No.35777/2025 dated 30.01.2026 and the same is not taken note of while declining interim order. - 5 - HC-KAR NC: 2026:KHC:25473-DB WP No. 16080 of 2026 7. Wherever the Government effects transfer without providing posting, the Tribunal shall take note of the Order dated 30.01.2026 in W.P.No.35777/2025 while considering the interim prayer or while considering the main application. 8.
