This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- “A. the Respondent No.2 Bank to immediately de-freeze bank account of the Petitioner, i.e. i. Savings/salary Account bearing number: 50100405353522 IFSC : HDFC0001668 Branch: Anand Vihar, New Delhi B. to expeditiously complete any investigation pertaining to the impugned amount and issue NOC to the Petitioner, so that the Petitioner is not to made to face any such hardship, This is a digitally signed order. The Order is downloaded from the DHC Server on 19/09/2026 at 11:47:31 C. to expeditiously remove any lien on bank account of the Petitioner if her involvement is not found in cyber fraud as alleged….” 2. There is nobody appearing for HDFC bank. Since the salary account of the petitioner has been frozen, there is urgency in the matter and the same is taken up for hearing. 3. Mr. Wadhwa, learned counsel for the petitioner, draws my attention to emails received from the respondent No. 2 bank wherein it has been stated that there are three disputed transactions in the petitioner’s account to the extent of Rs. 1,000/-, Rs. 5,000/- and Rs. 2042.85/-. 4. The freezing of the entire account for a transaction of Rs. 8042.85/- is an action entailing serious consequences creating hardships for the petitioner as the same happens to be her salary account and the petitioner is unable to meet her daily expenditure due to freezing of his account. The respondent bank cannot be permitted to take such a harsh measure without complying with the principles of natural justice and without any application of mind. 5. For the said reasons, I am of the view that the impugned action of account freezing in the present case is not only in clear violation of the principles of natural justice but also disproportionate and an arbitrary exercise of power thereby striking a blow at the fundamental rights of the petitioner. The impugned action is without due application of mind as an indiscriminate blanket freeze has been imposed on the accounts of the petitioner for an allegedly suspicious entry of a meagre amount. Therefore, the action deserves to be set aside. 6. Subject to the respondent, maintaining a lien on Rs. 8042.85, the petitioner shall be permitted to operate her account No. 50100405353522, This is a digitally signed order. The petitioner is also at liberty to take steps under the SOP for defreezing of the account. Additionally, the petitioner shall also file an affidavit that in case there are any other disputed amounts, the respondent No. 2 bank may mark a lien on that amount as well. 8. The needful shall be done expeditiously and not later than one week from today. 9. The petition is disposed of in the aforesaid terms.
