Petitioner has filed this petition seeking following relief (s) :- “10.1 Quash and set-aside the impugned communication dated 19.12.2024 (Annexure P-1) issued by the Collector, Korba. BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 10.2 Direct the respondents to process and finalize the petitioner’s case for compassionate appointment without insisting upon a succession certificate. 10.3 Direct the respondents to issue necessary appointment order to the petitioner on compassionate grounds at the earliest. 10.4 Pass any other order deemed fit and proper in the interest of justice.” 2. Learned counsel for petitioner submits that father of petitioner died in harness while working on the post of Assistant Programme Officer at District Education Officer – cum - Programme Officer, Korba. After death of father on advice given to them, petitioner has submitted an application for grant of compassionate appointment. Application submitted by petitioner was considered by the Collector and according to instruction received, Collector has forwarded the same to the Director Public Instructions seeking approval/permission to consider the application submitted by petitioner as it was submitted beyond period of three years but within period of five years, however, till date the Director Public Instructions has not considered the proposal forwarded by Collector. 3. Learned State counsel submits that according to his instruction, application for grant of compassionate appointment submitted by petitioner was forwarded to the Secretary, School Education Department as it was submitted beyond period of three years. Application submitted by petitioner was forwarded from the office of the Secretary School Education to the Director Public Instruction seeking opinion as to whether the claim of petitioner for grant of compassionate appointment can be considered or not and Director 3 Public Instructions after going through the relevant records has recommended to consider the claim of petitioner for grant of compassionate appointment relaxing the period prescribed in the consolidated circular of 2013. He also contended that as of now, proceedings for grant of compassionate appointment to petitioner is pending before the Collector and appropriate orders will be passed at the earliest. 4. I have heard learned counsel for parties and perused the documents placed on record. 5. Submission of application for grant of compassionate appointment by petitioner against death of his father, application submitted by petitioner was forwarded by Collector, Korba to Secretary, School Education Department and recommendations of Director Public Instructions granting relaxation in submitting application and to proceed further on the application submitted by petitioner is the instruction of counsel for State. It is also submission of counsel for State that from the office of Secretary School Education now the claim/application of petitioner is pending before the Collector for passing appropriate orders 6. In the aforementioned facts of the case I find it appropriate to dispose of this writ petition at this stage directing respondent No.2 to consider the application submitted by petitioner for grant of compassionate appointment along with letter of Director Public Instructions to the Secretary School Education Department dated 18.02.2026 in accordance with law expeditiously preferably within further period of three months from the date of receipt of order and to pass appropriate 4 orders on the claim of petitioner for grant of compassionate appointment. 7.
