THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA I.A.Nos.1 and 2 of 2026 In/and CRIMINAL PETITION NO: 1773/2026 COMMON ORDER:
The instant Criminal Petition under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023(for short ‘BNSS act’) has been filed, by the Petitioners/accused Nos.1 and 2, seeking to quash the proceedings against them in C.C.No.658 of 2024, pending on the file of learned I Additional Judicial Magistrate of First Class, Proddatur. 2. I.A.No.1 of 2026 is filed by the 2nd respondent/de-facto complainant, seeking to compound the case in C.C.No.658 of 2024, by recording compromise. 3. I.A.No.2 of 2025 is filed by the 2nd respondent/de-facto complainant and petitioner and respondent No.2, seeking to compromise by compounding the C.C.No.658 of 2024 on the file of learned I Additional Judicial Magistrate of First Class, Proddatur. 4. Sri V.Nitesh, learned counsel for the petitioners, Sri N.Sai Akash, learned counsel for respondent No.2 and Sri K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State is in attendance. 5. Today, when the matter is taken up for hearing, petitioners/accused No.1 and 2 and the respondent No.2/complainant are present before this Court. They produced their respective attested copies of Aadhar cards in proof

of their identity and the same were placed on record for proper identification. Both the learned counsels on record have identified their respective parties in the open Court. 6.
The complainant/respondent No.2 represented that he has voluntarily come forward to enter into compromise in this case since the accused had not committed any offence as stated in the complainant and the wall posters at that relevant time were removed by some other persons and not by the petitioners and disputes were settled between them out of the Court and there is no force or fear to enter the compromise in this case. 7. Learned Assistant Public Prosecutor would submit that compromise may be recorded since the complainant/respondent No.2 himself represented that there is no case to prosecute. 8. Considering the submissions made, it is apposite to allow the I.A.Nos.1 and 2 by closing the case in C.C.No.658 of 2024, pending on the file of learned I Additional Judicial Magistrate of First Class, Proddatur. 9. Accordingly, I.A.Nos.2 and 3 are allowed. 10. Since both the parties entered into compromise and case against the accused is quashed, no further orders are required in this matter. Accordingly, this Criminal Petition is allowed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. __________________________________________ DR.
