CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 2 18-06-2026
1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that she was cutting sugarcane on her land when accused persons including the petitioners came and started claiming the land, further Jawahir (petitioner No. 1) assaulted the informant
Patna High Court CR. MISC. No.37500 of 2026(2) dt.18-06-2026 2/3 by farsa causing injury on head, while Rajesh (petitioner No. 2) assaulted her by lathi all over the body and snatched her mangalsutra, thereafter Ramashankar (petitioner No. 3) assaulted Anita by gadasa causing injury on head, further Marcho Devi snatched nose pin of the informant and Rajesh along with Neeraj assaulted Jewan Devi by labada all over her body on account of which she became unconscious and when Chottelal came to save them, accused persons also assaulted him.
4.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that on account of dispute relating to land, an altercation took place in which both sides assaulted each other but then the FIR came to be instituted with an exaggerated allegation of assault. It is further submitted that from perusal of the injury report of the injured as annexed as Annexure-3 to the anticipatory bail application, it would manifest that the injury suffered by the injured has been opined to be simple in nature. It is reiterated and submitted that petitioners are persons with clean antecedent.
5. Learned A.P.P. for the State, Ms. Gulnar Begum, opposes the prayer for anticipatory bail of the petitioners but
Patna High Court CR. MISC. No.37500 of 2026(2) dt.18-06-2026 3/3 then fairly submits after perusing the Annexure-3 to the anticipatory bail application that injury suffered by the injured has been opined to be simple in nature.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Majhauliya P.S.
